Welcome to Framentor (“Framentor,” “we,” “our,” or “us”). These Terms & Conditions (“Terms”) govern your access to and use of the website https://framentor.com (the “Site”) and any services, subscriptions, or related offerings provided by Framentor (collectively, the “Service”).
By accessing or using our Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not access the Service.
1. Eligibility and Account Registration
1.1 Eligibility: You must be at least the age of majority in your jurisdiction to use the Service. By using the Service, you represent and warrant that you have the legal capacity and authority to enter into these Terms.
1.2 Account Creation: To access certain features, including our premium (“Pro”) components, you must create an account. During registration, we may collect information including, but not limited to, your first name, last name, email address, and profile picture (if provided). You agree to provide accurate, current, and complete information and to keep your account information updated at all times.
1.3 Account Security: You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account. You agree to immediately notify us at support@framentor.com of any unauthorized use of your account.
2. Our Service
2.1 Description: Framentor provides component libraries for Elementor. You can copy JSON code and paste it into your Elementor setup, transforming it into components for use on your website. We also offer a Chrome extension to facilitate this process.
2.2 Usage Limits: Free and Pro accounts are subject to a fair usage limit. You may copy up to 100 components per day. This limit resets daily at midnight UTC. Once you hit the limit, you must wait until the reset or contact support if you believe you have a valid reason to exceed it.
3. Subscription Plans, Payments, and Refunds
3.1 Payment Terms: We offer monthly, yearly, and lifetime subscription plans for Pro access. Payments are processed through Stripe. By providing your payment information, you authorize us (and Stripe) to charge your payment method on a recurring basis if you select a subscription plan.
3.2 Taxes: Depending on your location, we may be required to charge VAT or other applicable taxes. If we charge taxes, they will be clearly stated at checkout. If you are purchasing from outside the EU or other regions where we have tax obligations, you are responsible for any applicable taxes or duties as required by your local laws.
3.3 Refund Policy: We offer a 14-day refund period. To request a refund, you must contact us at support@framentor.com within 14 days of your initial purchase. However, if you have copied more than 100 components within that 14-day period, you are not eligible for a refund.
4. License and Permitted Use
4.1 License Grant: During your active subscription, we grant you a non-exclusive, non-transferable, revocable license to use our components for your personal or commercial projects. This includes use on your own websites or on client websites.
4.2 Prohibitions: You may not redistribute or resell our components as part of your own component library or as standalone products. You may not claim our components as your own or use them to create a competing service.
4.3 Termination of License: Upon expiration or cancellation of your subscription, you will lose access to our Pro components and the Service’s premium features. However, any components you have already integrated into your websites will remain functional, as they are code that has already been copied and used.
5. Intellectual Property
5.1 Ownership: All Framentor trademarks, logos, branding, and original content remain our property. Except for the limited license granted in Section 4, all rights, title, and interest in and to the Service and its components are reserved by us.
5.2 No Reverse Engineering: You agree not to reverse engineer, decompile, or otherwise attempt to extract the source code of our proprietary code or technology, except as permitted by law.
6. Affiliate Program
6.1 Affiliate Terms: If you participate in our affiliate program, you agree to adhere to the program rules. Affiliates may not self-refer, may not use brand keywords in ads, may not list our products on coupon/deal websites, and may not create misleading advertising implying they represent Framentor.
6.2 Violation: We reserve the right to suspend or terminate your affiliate account and withhold commissions if we believe you have violated the affiliate program rules.
7. Termination and Suspension
7.1 Termination by Framentor: We may suspend or terminate your account without prior notice if you violate these Terms or engage in illegal activities. Upon termination, you lose access to the Service and any Pro features.
7.2 Survival: Any terms that by their nature should survive termination (e.g., disclaimers, liability limits) will remain in effect.
8. Disclaimers and Limitations of Liability
8.1 Disclaimer: The Service and components are provided “as is” without warranties of any kind. We do not guarantee that our components will function error-free or will not cause issues on your website.
8.2 Limitation of Liability: To the maximum extent permitted by law, Framentor will not be liable for any indirect, incidental, consequential, or special damages arising from or related to your use of the Service. This includes, but is not limited to, lost profits, lost data, or any website malfunctions.
9. Changes to These Terms
We reserve the right to update or modify these Terms at any time. By continuing to use the Service after changes are posted, you agree to be bound by the revised Terms.
10. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising out of or relating to these Terms shall be resolved exclusively in the courts of the Netherlands.
